NAWM Comments on Proposed CWA 404(g) Regulations
The National Association of Wetland Managers (NAWM, formerly the Association of State Wetland Managers (ASWM)) submitted comments in response to the proposed rule, “EPA–HQ–OW–2020–0276. 40 CFR Parts 123, 124, 232, and 233; revision to the regulations governing Clean Water Act (CWA) section 404 Tribal and State programs”. The NAWM letter addresses the following key issue areas: 1) importance of working with states and tribes to provide resources to support assumption; 2) importance of a collaborative relationship between States and Tribes and EPA during the application process; 3) developing procedures to coordinate with neighboring Tribes and States; 4) development of clear expectations for applying States and Tribes; 5) importance of clearly articulating the retained waters analysis.
